DISH Home Protection Plan
TERMS AND C ONDITIONS
This Plan is not a contract of insurance. Unless otherwise regulated under state law, the contents
under this Plan should be interpreted and understood within the meaning of a “service contract
in Public Law #93-637.
Definitions. Here are some terms used in this Plan and what those terms mean:
Administrator means the part y responsible for administ ering t his Plan. Federal Warranty Service
Corporat ion is the Administ rator in all states exc ept in Florida where t he Administ rator is Unit ed Service
Protection Inc. and in Oklahoma where the Administrator is Assurant Service Protection, Inc. The address
and phone number of eac h Administrator is P.O. Box 105689, Atlanta, GA 30348-5689, 1-800-333-DISH
(3474). The service performed under this Plan is provided through the Administ rator or a service pro vider
approved by the Administrator.
Deductible means the disc ount ed in-home service fee of $10.00 to be paid by You for on-site
troubleshooting and repair of Your Produc t on-sit e.
Plan means these terms and conditions.
Product means the DISH Network Direc t Broadc ast Satellit e (DBS) video or satellite two-way high-
speed internet hardware covered under this Plan.
Provider/We/Us/Our means the entity c ontractually obligated to You under the terms of this Plan.
The Provider is Federal Warranty Service Corporation in all states except in Florida where the Provider
is United Service Protection, Inc. and in Oklahoma where the Provider is Assurant Service Protection,
Inc . The address and phone number of eac h Provider is P.O. Box 105689, Atlanta, GA 30348-5689, 1-
800-333-DISH (3474).
Purchase Price means the amount You pay eac h month for this Plan list ed in Your DISH Ne t w ork
monthly billing statement.
You/Your means the individual who purc hased or leased the Product covered under this Plan.
Eligibility for coverage. T his Plan is available t o new and exist ing DISH Net work subscribers who purchase
or lease DISH Network Produc ts. You represent that the Product is in proper operating condition at the start
of the Plan c overage and that Your DISH Network ac count is c urrent and in good standing.
How long is my Product covered? Your coverage begins on the effective date shown on Your DISH
Net work monthly billing statement and will continue on a month-to-month basis at the then-c urrent
published price unt il c ancelled by You or t erminated by Us. If You move to a new location within the coverage
area, this Plan will continue to c over Your Product. T his Plan is not t ransferrable. T HIS PLAN IS INCLUSIVE
OF THE MANUFACTURERS WARRANTY; IT DOES NOT REPLACE THE MANUFACTURERS WARRANTY, BUT
PROVIDES CERTAIN ADDITIONAL BENEFITS. LOSSES COVERED BY THE MANUFACTURER DURING THE
MANUFACTURERS WARRANTY PERIOD ARE NOT COVERED UNDER THIS PLAN.
What is covered? T he Plan c overs all Produc ts purchased or leased by You that are activated on Y our DISH
Network ac count and are inst alled at Y our loc ation. The Product will be rest ored t o normal c ondit ion after it
has failed during normal use. This Plan c overs all labor and part s c osts necessary t o repair Your Product for
problems due to func tional part failures such as the rec eiver, broadband compatible receiver, dish antenna,
remot e c ont rol, low noise block c onverter with int egrated feed, transmit and receive integrated assembly,
or mo d e m. T his Plan also c overs all labor and parts c osts necessary to repair power surge damage to Your
rec eiver or DISH Network inst alled inside video and/or internet c abling. T he Administ rat or, at its option,
may require t roubleshooting of the Product to verify any failure prior t o replac ement . T he Administra tor, at

its opt ion, may replac e Your covered Produc t with one of like kind and qualit y. Part s used to repair the
Product may be new, remanufactured, or used, at the Administrator’s sole disc retion.
What if I need help? Please call 1-800-333-DISH (3474). A servic e representative will assist You to
document Y our issue and determine if there is a covered failure. To the extent that Our assessment confirms
a c overed failure, We will proc ess Your c laim and arrange for servic e.
What type of service is available? The Administrator, at its sole discretion, may either ship a replacement
Produc t t o Y ou or dispat ch an authorized service provider to Y our loc ation. Our repair channels include:
Shipped Product Replacement If you are provided with a replac ement Product, then Y ou will be
required to return the defective Product to the address provided to You. Shipping costs are c overed
by the Plan. If You are provided with a replacement Produc t and You fail to return the defec tive
Produc t, then You will be assessed a fee for the unreturned defective Product. Shipped service is
available during normal working hours and work week of t he aut horized produc t service facilit y.
On-site service provided by an authorized service provider If the Administrator dispatches a service
provider t o Your loc ation, then You will be responsible for payment of t he Deduc tible. On-site service
is available during normal working hours and work week of the aut horized service provider. If the
Administ rator det ermines, in its sole disc retion, that t he problem with Your Produc t is not c overed
under this Plan, then Y ou will be responsible for t he c ost of any repairs if You agreed to the repair
cost provided to You prior t o servic e.
What are my responsibilities?
To keep this Plan in force during its term, You promise and assure: full cooperation with the customer
service agents and authorized service providers during diagnosis and repair of the Produc t; that You
will keep Y our ac count with DISH Network current and in good standing; to provide adequate access
to the Product during normal business hours; to provide a non-threatening and safe environment for
servicing; to not mislead, defraud, or make any misrepresentation to the authorized service
providers; to not falsify any related document s or rec ords; to fully disclose all relevant information
and fully c ooperate with the Administrator, its customer service agents and authorized service
providers to troubleshoot the Product; to protect against any further damage and to c omply with the
owner’s manual.
Compliance with Applicable Building Codes and Ordinances: It is Your responsibilit y t o ensure
c omplianc e with all applic able building c odes, zoning ordinanc es, covenants, c onditions, and
rest ric tions related to servic es provided under this Plan, to pay any fees or other charges, and to
obtain any permit s or authorizations nec essary for servic es provided under this Plan ( c o lle c t ively
"Legal Requirement s"). Y ou are solely responsible for any fines or similar c harges for servic e in
violation of any applic able Legal Requirement s.
What isn’t covered? This Plan doesn’t cover everything. Any failure due to the following is not
covered: SERVICE, MAINTENANCE, REPAIR, OR REPLACEMENT DUE TO ANY LOSS RESULTING
FROM USAGE OTHER THAN NORMAL USAGE AND BEYOND OUR NORMAL CONTROL SUCH AS:
DAMAGE DUE TO MISUSE, ABUSE, INSECT OR OTHER INFESTATION, FIRE, WATER, FOREIGN
SUBSTANCES, ORGANIC MATERIALS, WINDSTORM, HAIL, EARTHQUAKE, THEFT,
TERRORISM/WAR, NEGLIGENCE, RIOT, OR ACTS OF GOD; INSTALLATION AND INSTALLATION
WORKMANSHIP, IF THE INSTALLATION WAS NOT PERFORMED BY AN AUTHORIZED SERVICE
PROVIDER OR RETAILER OF DISH NETWORK PRODUC TS; INSTALLATIONS NOT GROUNDED IN
AC C ORDANC E WITH DISH NETWORK STANDARDS; RE-INSTALLATION AND/OR THE RE-
CONNECTION OF YOUR PRODUCT(S), IF PRODUCT REPLACEMENT IS SHIPPED TO YOU; EXTERIOR
OR C OSMETIC ITEMS OF THE PRODUC T INC LUDING, BUT NOT LIMITED TO, PAINT, F INISH,
BEZEL, C ORDS, CABLES, AND CONNEC TORS; NON-OPERATING COMPONENTS OF THE PRODUCT;
INTERNAL SOFTWARE, BATTERIES, AND C OMPONENTS NOT ESSENTIAL TO BASIC PRODUCT
FUNCTIONALITY; ANY COMPONENT OR PRODUCT THAT HAS BEEN OPENED, TAMPERED WITH,
REPAIRED, OR OTHERWISE ACCESSED BY ANYONE OTHER THAN AN AUTHORIZED SERVICE
PROVIDER; REPAIR OF PRODUCT UPON NONCOMPLIANCE BY YOU OF ANY PART OF YOUR

NOT SPEC IF IC ALLY LISTED IN THIS PLAN; SERVICE OUTSIDE OF OUR SERVICE AREA WHICH IS
THE C ONTINENTAL U.S., HAWAII, PUERTO RIC O, THE VIRGIN ISLANDS AND PORTIONS OF
ALASKA; AND Y OUR MONITOR, TELEVISION OR EQUIPMENT RELATED TO YOUR TELEVISION.
Can this Plan be cancelled? You may c ancel this Plan at any time by c alling 1-800-333-DISH (3474). New
DISH Subscribers: If You cancel this Plan within the first 180 days after activation of Your DISH Network
account, Y ou will not be charged the Purc hase Price and any applicable new subscriber c redits for the Plan
will end. If You cancel after 180 days of activation of Your DISH Network ac count, the Purchase Price paid
by Y ou is fully earned and You will not rec eive a refund or c redit. Existing DISH Subscribers: If Y o u c ancel
this Plan within 180 days of purchase of this Plan, the Purchase Price paid by Y ou is fully earned, Y ou will
not receive a refund or c redit, and You will be c harged a c ancellation fee of $30.00, where allowed by law.
If You c ancel this Plan after 180 days of purchase of this Plan, t he Purchase Price paid by You is fully earned,
You will not rec eive a refund or c redit, and You will not be c harged a c anc ellation fee. If t his Plan was
inadvertently sold to You on a Product which was not intended to be covered, We will c ancel this Plan and
return the full Purchase Price of the Plan to You. If We c ancel this Plan, You will be provided with a written
not ic e at least 30 days prior to c anc ellation at Y our last known address, with the effective dat e for the
c ancellation and the reason for cancellation. If We cancel, You will be refunded or c redited the unearned pro
rata amount of the Purchase Pric e for the then-current month, less any c laims paid, where allowed by law.
Are there any Plan limitations?
Limitation of Liability: T o the extent permitted by applic able law, Our liabilit y, if any, and/or t he liability, if
any, of any servic e provider, for any allegedly defec tive Produc t or part shall be limited to repair or
replac ement of the Product or part, at Our option. IN NO EVENT WILL WE OR ANY SERVICE PROVIDER BE
LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES RELATING DIRECTLY OR
INDIRECTLY TO THIS PLAN. T HIS PLAN IS YOUR SOLE EXPRESS WARRANTY WITH RESPECT TO THE
COVERED PRODUCT INCLUDING, BUT NOT LIMITED T O, IMPLIED WARRANTIES OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE WHICH ARE HEREBY EXPRESSLY EXCLUDED. NO WARRANTY IS
PROVIDED AND NO GUARANTEE IS MADE WHATSOEVER UNDER T HIS PLAN FOR THE QUALITY OR
CONTINUOUS TRANSMISSION OF ANY PROGRAMMING OR SIGNAL.
Please note that the following arbitration provision governs disputes between You and Us; any
dispute(s) between You and DISH Network is governed by the arbitration provision of Your DISH
Network Residential Customer Agreement.
Arbitration. Please read the following arbitration provision carefully. It limits certain rights,
including Your right to obtain relief or damages through court action.
To begin Arbitration, either You or We must make a written demand to the other party for arbitration. The
Arbitration will t ake plac e before a single arbit rat or. It will be administered in keeping with the Expedited
Proc edures of the Commerc ial Arbitrat ion Rules ("Rules") of the Americ an Arbitrat ion Association ("AAA") in
effect when the claim is filed. You may get a copy of these AAA's Rules by contacting AAA at 1633 Broadway,
10th Floor, New York, NY 10019, c alling (800) 778-7879 or visiting www.adr.org. The filing fees to begin
and c arry out arbitration will be shared equally between You and Us. This does not prohibit the arbitrator
from giving the winning party their fees and expenses of the arbitration. Unless You and We agree, the
arbit ration will t ake plac e in t he c ounty and st ate where Y ou live. T he Federal Arbitrat ion Act, 9 U.S.C. § 1,
et seq., will govern and no st at e, local or ot her arbit rat ion law will apply. Y OU AGREE AND UNDERST AND
THAT this arbitration provision means that You give up Your right to go to court on any claim
covered by this provision. You also agree that any arbitration proc eeding will only c onsider Your Claims.
Claims by, or on behalf of, other individuals will not be arbitrated in any proc eeding that is c onsidering Your
Claims. Please refer to the State Disclosures section of this Plan for any added requirements in Your state.
In the event this Arbitration provision is not approved by the appropriate state regulatory agency, and/or is
stricken, severed, or otherwise deemed unenforceable by a court of competent jurisdiction, You and We
spec ifically agree to waive and forever give up the right to a t rial by jury. Instead, in t he event any lit igation
arises between Y ou and Us, any suc h lawsuit will be tried before a judge, and a jury will not be impaneled
or struc k.

Does Your state have any other requirements? The following state specific requirements are
added to and become part of Your Plan and supersede any other provisions to the contrary:

The obligat ions under this Plan are insured by a policy of insuranc e issued by American Bankers Insurance
Company of Florida. If We fail t o pay or provide servic e on a c laim wit hin 60 days aft er proof of loss has
been filed with Us, the written c laim c an be submitted to Americ an Bankers Insurance Company of Florida
at t he following address: 11222 Quail Roost Drive, Miami, Florida 33157, or c all the t oll-free number at 1-
800-852-2244.
AZ, HI, MT, VA, and VT Residents: The obligations under this Plan are insured by a polic y of insurance
issued by Americ an Bankers Insuranc e Company of Florida, 11222 Quail Roost Drive, Miami, Florida 33157.
GA, LA, OR, UT, WI and WY Residents: Arbitration is deleted in it s ent iret y.
AK Residents: Coverage for t he Plan is only provided in the following zip codes:

subc ontractors or program ineligibility. We may cancel this Plan only in the event of fraud, material
misrepresent ation or non-payment by You. No claim incurred or paid shall be deducted from any cancellation
refund, regardless who initiates the c ancellation. All reference to a cancellation fee is deleted and replaced
with a cancellation fee of ten percent (10%) of the gross amount paid for Your Plan or thirty dollars ($30),
whic hever is less. T he following is added to t he Arbitration provision: Arbitration cannot be an absolute
dispute remedy and both parties must agree to arbitration. This arbitration provision does not prohibit an
Arizona resident from following t he proc ess t o resolve c omplaint s under the provisions of A.R.S. §20-

You may c ancel this Plan within 30 days after rec eipt of this Plan by providing writ ten not ic e to the
Administ rator. Y ou will rec eive a full refund if no c laims have been made. If Y ou c ancel aft er t he first 30
days from rec eipt of this Plan, You will rec eive a pro rata refund based on t he t ime remaining on Y our Plan.
CO Residents: Ac tions under this Plan may be covered by the provisions of the Colorado Consumer
Protection Act” or the “Unfair Practices Act”, articles 1 and 2 of title 6, C.R.S. A party to this Plan may have
a right of c ivil ac tion under suc h laws, inc luding obtaining the rec ourse or penalties spec ified in suc h laws.

CT Residents: The following is added t o the Arbitration provision: RESOLUTION OF DISPUTES: If We are
unable to resolve any disputes with You regarding this warranty, You may file a written complaint with the
State of Connec ticut, Insuranc e Department, P.O. Box 816, Hartford, CT 06142-0816, Attn: Consumer
Affairs. The written c omplaint must contain a desc ription of the dispute, the Purchase Price of the item
subject to the extended warranty, the cost of repair of the item, and a copy of the Plan. The following is
added to Can this Plan be cancelled: You may c ancel this Plan if You return the Product or if the Product
is sold, lost, stolen, or destroyed. If t he Produc t is in a repair fac ility at t he time of c ontract expirat ion, the
date will automat ically be extended until the repair is c omplete.
DC Residents: Free Look: You may, within thirty (30) days of rec eipt, return this Plan. Upon return of the
Plan wit hin the applic able t ime period, if no c laim has been made, the Plan will be void and You will be
refunded or Your ac count credited, the full Plan Purc hase Pric e. A ten percent (10%) penalty of the Plan
Purc hase Price per month shall be added to a refund that is not paid or credited within forty-five (45) days
aft er return of the Plan. T his provision applies only t o the original purc haser of this Plan. The Can this Plan
be cancelled provision is amended as follows: Any reference to a c anc ellat ion fee is deleted and replaced
wit h a c anc ellat ion fee not to exceed ten percent (10%) of the Plan Purchase Pric e, or thirt y dollars ($30),
whic hever is less. Prior writ t en notice is not required if t he reason for c ancellation is nonpayment of the Plan
Purc hase Price, a material misrepresentation by You to Us, or a substantial breach of duties by You relating
to the covered Product or its use.
FL Residents: The rate charged for this Plan is not subject to regulation by the Florida Offic e of Insurance
Regulat ion. The following is added to the Arbitration provision: While arbitration is mandat ory, the outcome
of any arbitration shall be non-binding on the parties, and either party shall, following arbitration, have the
right to rejec t the arbitration award and bring suit in a court of competent jurisdic tion. The arbitration action
will take place in the county where the Plan holder resides. Under Can this Plan be cancelled, the
c ancellation fee for Existing DISH Subsc ribers is deleted.
GA Residents: If a dispute arises between the English and Spanish versions of t his Plan, due to issues of
interpretation, the English version will prevail in all c ases. The Can this Plan be cancelled provision is
amended as follows: Canc ellation will be in ac c ordance wit h O.C.G.A 33-24-44 of the Georgia Code. T his
Plan shall be non-cancelable by t he Administrator exc ept for fraud, material misrepresent ation, or failure to
pay the consideration due therefore. If You are a New or Existing DISH Subscriber and Y ou c anc e l af te r 180
days of activation of Your DISH Network account, You will rec eive a pro-rata refund of the unearned Purchase

Pric e. No c laim inc urred or paid will be deducted from any c ancellation refund regardless of who init iates
the c ancellation. T he c ancellation fee for Exist ing DISH Subsc ribers is deleted.
IL Residents: This Plan c overs failure due t o normal wear and tear. Under Can this Plan be cancelled,
the c ancellation fee for Existing DISH Subscribers is deleted.
IN Residents: Proof of payment to the ret ailer that sold Y ou this Plan c onstit utes proof of payment to
Americ an Bankers Insuranc e Company of Florida, issuer of the insuranc e polic y that insures Our obligation.
ME Residents: Under Can this Plan be cancelled, t he c ancellation fee for Exist ing DISH Subscribers is
deleted.
MI Residents: If performance of the Plan is interrupted because of a strike or work stoppage at the
company's place of business, the effective period of the Plan shall be extended for the period of the strike
or work stoppage.
MN Residents: The Arbitration provision is amended as follows: Any Arbitration shall t ake plac e in the
state where You reside or at any other place agreed to in writing by You and Federal Warranty S e rvic e
Corporation.
MO Residents: Pre-existing c onditions are covered under this Plan. The obligations under this Plan are
insured by a policy of insurance issued by American Bankers Insurance Company of Florida, 11222 Quail
Roost Drive, Miami, FL 33157. In the event any covered service is not paid within 60 days after proof of loss
has been filed, including a c laim for the refund of the unearned Purc hase Pric e, or the Plan Administrator
ceases to do business or goes bankrupt, You may apply directly to Americ an Bankers Insuranc e Company
of Florida. The Can this Plan be cancelled provision is deleted and replac ed wit h the following: Y ou may
c ancel this Plan at any t ime by c alling 1-800-333-DISH (3474). New DISH Subsc ribers: If You cancel this
Plan within t he first 180 days after activation of Your DISH Network account, You will not be c harged the
Purc hase Pric e and any applicable new subscriber c redits for t he Plan will end. If Y ou c ancel after 180 days
of ac tivation of Your DISH Network account, the Purc hase Pric e paid by Y ou is fully earned and Y ou will not
receive a refund or c redit. Existing DISH Subsc ribers: If Y ou c ancel t his Plan within 180 days of purc hase of
this Plan, the Purc hase Pric e paid by You is fully earned, Y ou will not rec eive a refund or c redit, and Y ou will
be c harged a cancellation fee of $30.00. If You c ancel this Plan after 180 days of purchase of this Plan, the
