AGREEMENT FOR FENCING WORK

AGREEMENT
Jim Mitchell and Maria Herczeg agree for fencing work to be carried out between 156 and
154 Draft Street, Port Macquarie, New South Wales (the properties). The fencing work is to
be done as follows:
Fencing location
1. The fencing work is to be carried out on the common boundary line between the properties.
Fencing work
2. The existing dividing fence between the properties is to be demolished and removed.
3. A new 1.8 metre high cream-coloured colorbond fence is to be supplied and erected.
4. The new fence will be erected from the end of the common driveway to the rear common
boundary.
Fencing contractor
5. Mr Mitchell will engage Complete Fencing Pty Ltd (the 'Fencing Contractor'), to complete
the fencing work.
6. The work is to be carried out in accordance with the attached quote given by the Fencing
Contractor, dated 24 July 20XX.
7. The fencing work is to be completed within three (3) months of the date of this agreement.
8. The fencing work is to be carried out in a good and workmanlike manner using new
materials.
Costs
9. The total cost of the fencing work, being $2,500.00 is to be split equally between the
owners of the properties.
10. The Fencing Contractor is to be paid on the day work is completed.
11. Mr Mitchell will pay the Fencing contractor $2,500.00 on the day the work is completed.
12. Ms Herczeg will pay Mr Mitchell $1,250.00 on the day the work is completed.
13. The owners of the properties are both responsible for ensuring that the fencing work
complies with the Local City Council's Complying and Exempt Development Code for
Dividing Fences.
